Protection for Refugee Rights: International and Regional Instruments

Abstract

International protection for internally displaced persons, who far exceed the number of refugees, has become a major issue in recent years. This is reflected in the international community's search for solutions, by providing them with internal humanitarian assistance so that they do not have to seek help beyond the borders of their states, affirming their right to remain in their country in security and dignity and not to become refugees. However, reality has shown that the international community's attention to the protection of internally displaced persons is not so much a humanitarian consideration as it is an inevitable consequence of state reservations to welcome refugees on their territory. European states in particular have attached urgency to protecting internally displaced persons arbitrarily to justify the closure of their borders to refugees.

Canada , Communication No. 1051/2002, Views of (15 June 2004), paras. 10.6-10.8; وفي السوابق القضائية المسجلة ضمن هذا السياق، رأت اللجنة الأفريقية لحقوق الإنسان والشعوب، في قضية كينيث غود Kenneth Good، أن للاجئ الحق في سماع قضيته قبل طرده، وترجع حيثيات قضية السيد كينيث، وهو أسترالي الجنسية وأستاذ سابق للعلوم السياسية بجامعة بوتسوانا، إلى نشره مقالة انتقد فيها النموذج البوتسواني في تداول الرئاسة، تعرض بسببها للفصل التعسفي من الجامعة، والطرد من بوتسوانا؛ إذ أعلن رئيس بوتسوانا ممارسته للصلاحيات المخولة له بموجب قانون الهجرة، وإعلان السيد كينيث "شخصًا غير مرغوب فيه"، ومنحه 56 ساعة فقط لاتخاذ الترتيبات اللازمة لمغادرة البلاد، من دون أن يعلموه بسبب طرده، ولم تمنح له الفرصة للطعن في قرار ترحيله. وقد رأت اللجنة أن بوتسوانا انتهكت عددًا من حقوق السيد كينيث، بما في ذلك المادة 7 المتعلقة بكفالة حق التقاضي للجميع، ويشمل هذا الحق: الحق في اللجوء إلى المحاكم الوطنية المختصة؛ للنظر فى عمل يعدّ خرقًا للحقوق الأساسية المعترف له بها، وتتضمنها الاتفاقيات والقوانين واللوائح والعرف السائد؛ ومنها أيضًا أن الإنسان بريء حتى تثبت إدانته أمام محكمة مختصة، وحق الدفاع، بما فى ذلك الحق في اختيار مدافع عنه، وحق محاكمته خلال مدة معقولة بواسطة محكمة محايدة؛ ولا تجوز إدانة شخص بسبب عمل، أو امتناع عن عمل، لا يعدّ جرمًا يعاقب عليه القانون وقت ارتكابه، ولا عقوبة إلا بنص، والعقوبة شخصية. يُنظر: African Commission on Human and Peoples Rights, Good v.
