Abstract

This paper explores the issue of judicial independence in the post-2013 regime in Egypt. It specifically analyses the dynamics between the executive and the judiciary, highlighting the consequences on judicial integrity and justice. The analysis focuses on the constitutional legislation that governs the judiciary, subsequently delving into revisions made to this legislation since 2013. It explores the primary impediments to the independence of the judiciary, encompassing the increasing scope of the military judiciary's authority, the prosecution of judges who express dissent towards the government, and the court's incapacity to safeguard Egyptian sovereignty. The paper presents several ideas aimed at reforming the judiciary, including the restructuring of the Supreme Judicial Council, the establishment of transparent accountability and disciplinary regulations, and the implementation of equitable criteria for the recruitment of judges.
