الملخص

تكتسب هذه الدراسة أهميتها بوصفها الأولى التي تعالج مسألة اعتماد قانون "الأدلة السرية" في المحاكم الأوروبية وانعكاسه على حركة حماس، وتستند في الوقت ذاته إلى مصادر أولية لم يجرِ تناولها في هذا السياق من قبل. وسوف نستعرض فيها سياق التغييرات التي طرأت مؤخرًا على منظومة العدالة الأوروبية والأثر الذي تركته حركة حماس بهذا الشأن من خ لاا الالتماس الذي تقدمت به بهدف رفعها من قائمة الإرهاب أواخر عام.2010 كما سنناقش البعد السياسي في القانون الجديد والكيفية التي تم بها إلباسه اللبوس القانوني كي يبدو متسقًا مع مقتضيات العدالة. ونتناول أيضًا المواقف الحقوقية الدولية الخجولة وردود الأفعال على هذا التطور، والأدوار التي أدتها كل من أميركا وبريطانيا، والعدوى الإسرائيلية المتعلقة بالاتكاء المزمن على قانون الأدلة السرية. وننهي الدراسة بالحديث عن انعكاسات القانون الجديد على إمكانيات فشل حماس - كحالة - أو نجاحها في الإفلات الكلي من القائمة المذكورة قبل أن نصل إلى خلاصة الرأي بهذا الصدد.
