الملخص

تناقش هذه الدراسة نظرية التنبؤ من منظور أنّ العلم القانوني من حيث هو علم اجتماعي لا يمكنه اليوم أن يهرب من المسائل المعيارية للعدالة والأخلاق في تطبيق العدالة. ولا يمكن ببساطة رفض هذه المشكلات باعتبارها آراء غير علمية. وفي هذا السياق، سأقدم مناقشةً نقدية لواقعية ألف روس القانونية من جهة صلتها بنظريات العدالة الحديثة لدى هابرماس ورولز. سأعرض مرجعية نظرية التوقع في القانون. وبعد ذلك، أناقش نظرية التنبؤ لدى روس على نحو ما صاغها في كتابه في القانون والعدالة On Law and Justice ، ثم أقدم بعض الاعتراضات على نظرية التنبؤ. وأنا أذهب إلى القول إنّه لا يكفي وصف القانون المعمول به، بل يجب استكماله باعتبارات معيارية وأخلاقية تتعلق بإمكان العمل بالمصادر القانونية وبالأساس القانوني للطريقة القانونية.
